Sincerely, Serendipity ("we," "us," "our") is a sole trader business operated by Susannah Barbera, ABN 81 901 494 252, based in Queensland, Australia. These Terms & Conditions govern your use of our website www.sincerelyserendipity.com.au and any purchase made through it. By placing an order or using this website, you agree to these Terms & Conditions in full.

2. Our Products

2.1 All items sold by Sincerely, Serendipity are pre-loved (secondhand) and curated by us. Where gatherings are described as "one of one," this means the specific combination of pieces shown is unique and will not be restocked or reproduced once sold.

2.2 We make every reasonable effort to describe and photograph each gathering accurately, including size, condition, and fabric. Given the nature of pre-loved clothing, minor variations in colour (due to photography/screen display) and small signs of prior wear consistent with the stated condition should be expected.

2.3 Sizing is stated on each individual listing. Because pieces are pre-loved and vary gathering to gathering, we recommend reviewing size details carefully before purchasing.

3. Orders & Payment

3.1 All prices are listed in Australian Dollars (AUD). Sincerely, Serendipity is not currently registered for GST, and prices do not include GST.

3.2 Payment is required in full at the time of ordering via the payment methods offered on our website.

3.3 We reserve the right to cancel an order and issue a full refund if a gathering is found to be unavailable, damaged, or otherwise unable to be fulfilled after purchase.

3.4 Once an order is placed for a one-of-one gathering, it cannot be changed to a different gathering, as each is unique and sold individually.

4. Shipping

4.1 We ship within Australia via Australia Post and/or CouriersPlease. Estimated dispatch and delivery times are provided at checkout and are estimates only, not guarantees.

4.2 Risk in the goods passes to you upon delivery to the address provided at checkout. Please ensure your shipping address is correct - we are not responsible for orders sent to an incorrectly provided address.

4.3 Shipping is free on all orders within Australia. This cost is included in the listed price of each item and will not be added separately at checkout.

5. Exchanges, Credit & Refunds

5.1 Due to the one-of-one nature of our gatherings, we do not accept change-of-mind returns.

5.2 If a gathering does not fit or isn't right for you, we offer store credit rather than a refund. To receive store credit, the item must be returned to us in the condition it was sent, at your own cost for return postage, within 14 days of delivery. Once we receive and inspect the returned item, store credit will be issued. Store credit does not expire and can be used toward any future gathering.

5.3 Nothing in these Terms limits your rights under the Australian Consumer Law. Where goods fail to meet a consumer guarantee under the Australian Consumer Law (for example, if an item is significantly not as described, or arrives faulty in a way not disclosed), you may be entitled to a repair, replacement, or refund as required by law, regardless of our store credit policy above.

6. Gift Vouchers

6.1 Gift vouchers ("Give the Gift of Serendipity") are valid for 3 years from the date of purchase, in line with the minimum period required under the Australian Consumer Law.

6.2 Gift vouchers are not redeemable for cash and cannot be replaced if lost, unless required by law.

6.3 If Sincerely, Serendipity ceases trading before a gift voucher has been fully redeemed, we will, wherever reasonably possible, refund the remaining unredeemed value of the voucher in cash to the last known holder, in place of continued redemption against a gathering.

6.4 Gift vouchers may be used toward any gathering up to their stated value; any difference in price above the voucher value must be paid by the recipient at checkout.

7. Intellectual Property

7.1 All content on this website - including but not limited to photography, gathering names, the Sincerely, Serendipity name and logo - is owned by us and may not be copied, reproduced, or used without our written permission.

8. Limitation of Liability

8.1 To the maximum extent permitted by law, Sincerely, Serendipity is not liable for any indirect, incidental, or consequential loss arising from your use of this website or your purchase of our products.

8.2 Nothing in this clause excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.

9. Privacy

9.1 Any personal information you provide to us (such as your name, address, and contact details) is collected and handled in accordance with our Privacy Policy, and used only to fulfil your order and communicate with you about it.

10. Changes to These Terms

10.1 We may update these Terms & Conditions from time to time. Changes will be posted on this page with an updated "last updated" date. Continued use of the website after changes are posted constitutes acceptance of the updated Terms.

11. Governing Law

11.1 These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms or your use of this website are subject to the exclusive jurisdiction of the courts of Queensland.
